Welcome to Penny Duck. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

1. Service Description

Penny Duck is a personal and shared finance tracking platform. It allows you to record transactions, manage accounts, categorize spending, and collaborate with others through shared workspaces.

Penny Duck is not a bank, financial institution, or financial advisor. We do not hold, transfer, or manage your money. The service is a tool for tracking and organizing your financial information.

2. Accounts and Workspaces

To use Penny Duck, you must create an account with a valid email address and password. You are responsible for maintaining the security of your account credentials.

Workspaces allow multiple members to collaborate on shared financial tracking. When you join a workspace, other members of that workspace can view the financial data within it. You should only share workspace access with people you trust.

As a workspace owner, you are responsible for managing member access and ensuring that invited members are appropriate.

3. User Responsibilities

You agree to:

  • Provide accurate information when creating your account
  • Keep your login credentials secure and not share them with others
  • Use the service only for lawful purposes
  • Not attempt to gain unauthorized access to other users' data or accounts
  • Not interfere with or disrupt the service or its infrastructure

4. Your Data

You retain ownership of all financial data you enter into Penny Duck. We do not claim any intellectual property rights over your content.

You may export or delete your data at any time. Upon account deletion, your data will be removed in accordance with our Privacy Policy.

5. Intellectual Property

The Penny Duck platform, including its design, code, branding, and documentation, is owned by Penny Duck. You may not copy, modify, distribute, or reverse-engineer any part of the platform.

6. Disclaimers

Penny Duck is provided "as is" and "as available" without warranties of any kind, whether express or implied.

We do not guarantee that:

  • The service will be uninterrupted or error-free
  • The data you enter will be preserved indefinitely (though we take reasonable measures to protect it)
  • The service is suitable for any particular financial, tax, or legal purpose

Penny Duck does not provide financial advice. Any decisions you make based on data in the platform are your own responsibility.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Penny Duck and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits arising from your use of the service.

Our total liability for any claim related to the service shall not exceed the amount you paid us in the 12 months preceding the claim, or EUR 100, whichever is greater.

8. Termination

You may delete your account at any time. We may suspend or terminate your access if you violate these terms or if we discontinue the service.

Upon termination, your right to use the service ceases immediately. We will handle your data in accordance with our Privacy Policy.

9. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify you by email or through the service. Your continued use of Penny Duck after changes take effect constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by the laws of Poland. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Poland, without prejudice to applicable EU consumer protection regulations.
